36th Annual Conference (November 28 - December 2, 2011)

Presentation Overview:

The ADA, ADAAA, HIPAA, FMLA, GINA, FEHA, CFRA, PDL ... The "alphabet soup" of federal and state laws governing employee medical conditions and leave issues can be daunting. Often, these laws intersect in unforeseen ways and create unanticipated pitfalls for the unwary.

This program will present three separate case studies that raise complex medical/leave issues under the aforementioned federal and state laws. The program aims to be interactive and invite audience participation in addressing the myriad potential issues presented by the case studies. The goal of the discussion will be to identify best practices for avoiding liability for failing to protect employee rights with respect to health, disability, and leave-related issues. The program will highlight new regulations under the ADAAA, GINA, and the FMLA recently adopted by federal regulatory agencies. The program also will highlight recent case law developments in this complex and ever-changing area of workplace management.
