The sharp increase in electronic communication and the use of computers and new technology to conduct business has led to a unique set of concerns and questions for government agencies. What potential liabilities and pitfalls for public agencies are created by the rapidly increasing use of electronic communication and social media? Do you have to pay overtime to an employee who checks her blackberry in the evening? Can you fire an employee for making unflattering statements about his boss on his Facebook page? What issues under the First, Fourth, and Fourteenth Amendments to the U. S. Constitution do public agencies face as a result of increased use of electronic media in the workplace?
