Overview:

In an era of shrinking budgets and workforces, public agencies often look to supplement their workforces through the use of retired annuitants, independent contractors, or even volunteers. Yet, the use of any of these “alternative workforces” carries with it significant risks, particularly in light of recent legislation imposing new restrictions on the circumstances under which public agencies may employ retired annuitants and new penalties for misclassifying employees as independent contractors. This presentation will address the risks associated with utilization of retired annuitants, independent contractors, and volunteers. The presentation will highlight requirements imposed by new legislation that took effect in 2012, as well as new restrictions on the employment of retired annuitants contained in the Public Employees’ Pension Reform Act of 2013 (PEPRA).
