Presentation Overview:

In an era of shrinking budgets and workforces, public agencies often look to supplement their workforces through the use of independent contractors, retired annuitants, or volunteers.  Yet, the use of any of the “alternative workforces” carries with it significant risks, particularly in light of recent legislation imposing new penalties for misclassifying employees as independent contractors and restricting the circumstances under which public agencies may employ retired annuitants.  This presentation will address the risks associated with utilization of independent contractors, retired annuitants, and volunteers, including the requirements imposed by new legislation that took effect in 2012.

This presentation will address:

  • The requirements for establishing an independent contractor relationship pursuant to such authorities as Metropolitan Water District v. Superior Court (Cargill) (2004) 32 Cal.4th 491, as well as common misclassification problems.  The presentation also will focus on the new penalties imposed on employers for misclassifying employees as independent contractors pursuant to SB 459, which took effect January 1, 2012.
  • The new requirement for utilizing retired annuitants pursuant to AB 1028, which took effect January 1, 2012.
  • Best practices for properly documenting and administering relations with independent contractors, retired annuitants, and volunteers to avoid missteps and potential liability.
