Session Overview:

There have been several recent decisions regarding whether debtors can hold the clients of collection attorneys vicariously liable for the actions of their attorneys.  Some courts have held that even creditors can be held liable under the Fair Debt Collection Practices Act as a matter of course, while other courts have held that clients must exercise some control over the acts of their attorney or consent or ratify the allegedly wrongful conduct.  Creditors and collection attorneys alike should be very interested in arguments that appear to be working and ones that don't appear to be working, as well as jurisdictions from which more favorable decisions are coming, as well as jurisdictions that appear to be more likely to rule in favor of vicarious liability.
