Program Overview:

New 2014 Legislation, such as:

  • AB 1522 (Gonzalez) – Mandatory paid sick leave
  • AB 1443 (Skinner) – FEHA protections extend to unpaid interns
  • AB 2053 (Gonzalez) – Biannual anti-sexual harassment training must also include training regarding “abusive conduct”
  • SB 1360 (Padilla) – Compensation for rest and recovery periods

New case law, such as:

  • Sandifer v. United States Steel Corp. – U. S. Supreme Court clarifies compensability of “donning” and “doffing” under Fair Labor Standards Act
  • White v. County of Los Angeles – Employer may seek its own fitness-for-duty certification following employee’s FMLA leave despite treating physician’s note that employee was able to return to work
  • Jones v. Farmers Ins. Exh. – Court properly certified class claiming uniform policy of denying compensation for pre- and post-work activities
  • Beaumont-Jacques v. Farmers Group, Inc. – Summary judgment in favor of employer based on independent contractor classification affirmed by Court of Appeal
