Presentation Overview:

This session will explore the difficult personnel choices – such as furloughs, layoffs, and wage and benefit reductions – public employers face in today’s era of declining budgets. The session will focus on:

Collective bargaining provisions that can aid in, or inhibit management from, achieving personnel cost reductions, e.g., management rights clauses and provisions regarding work schedules, layoffs, wages, and benefits.

Anticipating and defending claims arising from furloughs, layoffs, and other personnel cost-saving steps, including:

• Fair Labor Standards Act claims;
• Claims under public labor relations laws (MMBA, Dills Act, EERA, etc.);
• Impairment of contract claims;
• Due process claims; and
• Disparate impact claims.
