Presentation Overview:

Participants will be provided with a background of recent court cases and OCR guidance concerning a district’s responsibility for preventing student-to-student harassment and bullying, including recent legal developments regarding cyberbullying. Using case examples, participants will learn when a failure to act can lead to money damage claims against both administrators and districts. Participants will learn also how to avoid lengthy complaint procedures and litigation through effective policies and procedures for dealing with harassment and bullying. Topics to be covered will include: cyberbullying; bullying that may rise to the level of discriminatory harassment; potential due process claims for denial of FAPE based on bullying; and
pending legislation.
